PARTIES AND SUBJECT
This contract is between the OZPALMIRA TURIZM SEYAHAT which is located at Hasanpaşa Mah. İrfan Bey sok. No:10 Daire:28 Kadıköy – İstanbul, has the contact number +90 532 453 03 63 and the person who will complete the online booking process (referred to as the CONSUMER in the contract) via qxtravel.org. The address, identity and contact information used by the consumer when becoming a member are taken as basis.
1- The consumer who purchases accommodation on our site is obliged to pay the entire service fee at the time of reservation. The reservation is not finalized until the full payment has been made.
2- In case of an increase in the price of the contract, the difference will not be demanded from the consumer, and the discounts will also not be refunded to the consumer.
3- If it is not possible for the consumer to participate in the purchased tour and activity service, the consumer may notify the QX Travel officials at least 3 days before the start date of the tour or activity and transfer the reservation to a third person who will fulfill all the terms of the contract. In this case, the transferring person and the transferee are responsible for paying the balance to the QX Travel and all additional costs arising from that transfer. In case that consumers do not have a visa or even though they have made an application but they do not obtain a visa from the relevant ministry until the tour and activity start date, QX Travel does not accept any type of responsibility and collects the full amount of the booked tour or activity from the transferee and transferring person. If the person who takes over the service does not have the same status as the transferee, the transfer does not take place or the transfer is completed by removing the special discounts made.
4- QX Travel may change / cancel the reservation partially / completely before or after the service starts due to a reason not caused by the consumer. The consumer can accept these changes or accept another alternative service offered by QX Travel. If the consumer does not accept the changes, he has the right to cancel his reservation and receive the full refund of the price he has paid under the contract. Even though OZ PALMIRA TURIZM Travel has taken all necessary care, but may cancel or postpone the reservation due to strikes, terrorism, probability of war, unpredictable technical issues, bad weather conditions preventing tour and activities, and all such force majeure reasons. In case the consumer requests for the change of the service, provided that this change is deemed appropriate by QX Travel, the consumer must pay the difference immediately to QX Travel, with the acceptance of the change request, if there is a price difference between the service received and the new request. However, if the price of the new service is lower than the previous service price, QXTravel will refund the difference to the consumer. In case the consumer does not inform in writing that he has missed the start of the tour or activity; QX Travel reserves the right to cancel all reservations and services made on behalf of the consumer. In such cancellations, no refund is made to the consumer.
5- QX Travel and the consumer will perform their obligations arising due to this contract as required.
6- QXTravel is obliged to forward the Preliminary Information Form / Voucher / Mail to the consumer as specified in article 8 of the contract, which includes preliminary information regarding the quality of the service subject to this contract, sales price and payment method and performance. QX Travel is not responsible for situations arising from the consumer and the personal responsibilities of third parties.
7- The consumer acknowledges and agrees that he / she gives e-mail, mobile phone, fax etc. information given to QX Travel employees and / or websites, and that he / she sends newsletters made by QX Travel and websites for the purpose of campaign announcement. In the event that the consumer declares that he / she does not want notifications and announcements made to his / her communication channels, QX Travel undertakes to terminate the e-mail, sms, fax and mail sending.
8-All about the resolution of all disputes arising from this agreement are authorized by law from the Executive Office of the Republic of Turkey, Nevsehir Court, the Arbitration Committee for Consumer and other authorized organizations. If one or more articles of the contract are considered invalid for any reason, other provisions of the contract will not be affected by this invalidity and will remain in effect. This contract has been arranged in accordance with the provisions of the Law No. 6502 on the Protection of Consumers, and the provisions of the Law No. 6502 and the relevant regulations are valid for issues not regulated in the contract. It is deemed to have accepted and committed the terms of the contract by the consumer signing this contract / approving it electronically.
